Subject: AMLA’s Final Reports regarding the RTS under articles 28(1), 19(9), 16(4) and 17(3) of the AMLR
Purpose: To inform Regulated Entities that AMLA finalised three sets of Regulatory Technical Standards and published the final reports, along with accompanying communication material in the form of factsheets.
In Summary:
CySEC has issued the Circular C806 on 13/10/2026 to inform the CIFs, ASPs, UCITS Management Companies, Internally managed UCITS, AIFMs, Internally managed AIFs, Internally managed AIFLNPs, Companies with sole purpose the management of AIFLNPs, Crypto Asset Service Providers, Small AIFMs under Law 81(I)/2020 and Crowdfunding Service Providers, that the Anti-Money Laundering Authority (the ‘AMLA’) finalised the following three sets of regulatory technical standards (the ‘RTS’) and published on its website the final reports, along with accompanying communication material in the form of factsheets:
• Article 28(1) of Regulation (EU) 2026/1624 (the ‘AMLR’) – Draft RTS on Customer Due Diligence.
• Article 19(9) of the AMLR – Draft RTS on criteria for identifying business relationships, occasional and linked transactions and lower thresholds.
• Articles 16(4) and 17(3) of the AMLR – Draft RTS on group-wide minimum requirements and additional measures for subsidiaries and branches in third countries.
CySEC further informs that final draft standards were submitted to the European Commission. Once adopted and published in the Official Journal of the EU, they are proposed to apply six months after their entry into force.
In accordance with Circular C806, CySEC urges the Regulated Entities to study the published material and adopt the content of the new RTS by proceeding with the necessary changes to their policies, checks, systems and procedures.
